PORTLAND, Ore. (From news reports) -- Nippon Dynawave Packaging will have to pay for the clean-up effort after an industrial tank containing white liquor failed on May 26 at a paper mill in Longview.

A spokesperson for the Washington Department of Ecology confirmed Monday that it plans to issue an Order for Reimbursement to Nippon Dynawave for all necessary state expenses incurred as part of the response to the tank failure, which killed 11 people and injured 8.

State law allows the department to require reimbursement for responses that incur $1,000 or more in charges. Expenses can include staff wages, travel, lab fees, materials and more.

If a company is responsible for the spill of a hazardous substance, state law allows the department to require the reimbursement of expenses to respond, assess and investigate. It can also require the company to pay for a resource damage assessment and a penalty for violation.

The department is still calculating the cost of the clean-up effort and does not expect to have an estimate for at least another month or two, the spokesperson said.

Once the state sends Nippon an invoice for the costs, the company will have 30 days to either pay the amount or issue an application for relief.

Last week, the state announced it will investigate two other kraft pulp paper mills in response to the Longview incident. Records show there were at least two open investigations at Nippon at the time of the accident.

Nippon did not respond to an email request for comment.
